Abstract

In Brazil, public policies aimed at children and adolescents followed the doctrine of the irregular situation, treating abandonment, social vulnerability and infractions with compulsory hospitalization, prevailing as a guide for state action until the Federal Constitution/1988, which inaugurated the doctrine of integral protection, regulated by the Child and Adolescent Statute – Law 8069/90. However, public policies continued to be developed for some time due to the irregular situation, mainly with regard to socio-educational measures, due to the lack of a system that better regulates inter-federal attributions. The National System of Socio-educational Assistance – SINASE, created through Law No. 12,594/2012, acts as a guarantee system in the fulfillment of socio-educational measures, establishing guidelines and rules for socio-educational public policies. The present research sought to answer how the Municipality of Uberlândia/MG organizes and manages public policies for the execution of socio-educational measures, in view of the doctrine of integral protection and the guidelines of SINASE, with the general objective of understanding and interpreting the form of organization and management of public policies by the entity studied, identifying in its process of construction and management the guarantees of the fundamental right to the integral protection of children and adolescents. The study qualified as a descriptive case study, with a qualitative approach, and was developed with the collection of data from the public domain and obtained indirectly, categorized into groups by subject, namely: historical data, guidelines for the execution of measures of open environment (PSC and LA), administrative organization and program management. The analysis of the collected documents allowed us to conclude that the studied municipality adopts the general guidelines for public policies for the execution of socio- educational measures, however, the execution of the programs and their management still face limitations in terms of popular participation in the direction of these policies, which occurs by through the CMDCA. It is also inferred a limitation in the technical team that works in the care of adolescents in conflict with the law in compliance with the LA and PSC measures, since it lacks a lawyer in its composition, being possible to indicate possibilities for improvements in the composition of the technical team. and in the effective performance of the CMDCA, as an arm of organized civil society in the creation and management of public policies, regarding the registration and inspection of assistance programs.
